Candidates will have a minimum of 8 years of experience in patent litigation, with a focus on consumer products-related litigation (consumer electronics, software and hardware). We are looking for a litigator with large law firm experience that can handle and manage multiple simultaneous patent litigation matters.

Patent Litigation Council

- Manage and oversee U.S. patent litigation including preparation of discovery, review and preparation (as necessary) of pleadings, setting strategy, and making recommendations regarding case disposition.
- Review claims and set strategies as requested, conduct routine depositions and arbitrations, and coordinate discovery between internal operations and outside counsel and experts.
- Handle counsel selection, manage outside counsel, coordinate litigation strategies, work with other in-house counsels, and control related litigation costs.
- Manage the litigation caseload in-house, whenever possible, to minimize the cost of outside counsel.
- Advise on legal issues relating to patent negotiations or disputes.
- Provide legal counsel and develop and conduct internal legal training for records and information management, and other areas of expertise.
- Provide support for and oversee the Company records management program, including maintaining and updating the records and information policy and retention schedule, ensuring compliance with e-discovery obligations, providing training on records creation and disposition, and ensuring general corporate compliance in the area of records management.
Key Tasks Will Include
- Extensive experience in products liability and patent disputes, setting case strategy, managing discovery process, taking and defending depositions, and managing mediations/arbitrations and trials are required.
- J.D. degree, licensed to practice in NC or eligible for waiver into NC, a minimum of 5 years of litigation management and trial focused on products liability and patent cases, with a large national law firm.
- Technical degree, electrical engineering, computer engineering, or physics preferred.
- Registered to practice before the USPTO.
- Extensive trial (state and federal) and arbitration experience with a nationally recognized law firm handling complex products liability and patent litigation matters is highly preferred.
- Must have demonstrated success counseling clients and litigating complex cases with a top tier law firm or in-house setting.
- Ideal candidate will possess consumer products litigation experience, with a focus on electrical products.
- Litigation and litigation management experience required.
- Must have a stable work history with few transitions.
- A demonstrated ability to work in a corporate environment, work across functions, and provide practical, thoughtful solutions is required.
- Must be comfortable working in a dynamic environment where decisions are made and advice given in practical real-time. Ability to work independently, assimilate to an existing team and customers.

- Reporting to the CEO, the Patent Litigation Counsel will be the point of contact for coordinating IP licensing and enforcement efforts, providing oversight and direction of outside counsel, and controlling the attendant costs. The Litigation Counsel will provide legal advice and guidance on a wide range of issues (i.e. internal as well as external litigation support) with a focus on patent litigation, and prepare documents to support the Company's legal initiatives and interests.
- The Litigation Counsel will be responsible for (1) management and oversight of patent litigation; (2) oversight of company-wide records management program, and (3) counseling in other substantive areas, as needed.
